Shop Austins (hereinafter referred to as "we," "us," "our") offers a mobile messaging program (the "Program") through which customers can opt-in to receive updates, promotions, and other information via SMS/MMS messages. By participating in the Program, you agree to these Mobile Messaging Terms and Conditions and our Privacy Policy (the “Agreement”). By opting into or participating in our Program, you accept and agree to these terms, including resolving disputes with us through binding arbitration, as detailed below. This Agreement applies exclusively to the Program and does not alter any other agreements or terms that may govern your relationship with us in other contexts.

  1. User Opt-In: By enrolling in the Program, you agree to receive automated marketing and promotional messages from us, sent to the phone number associated with your opt-in. Consent to these messages is not required as a condition of any purchase. Message and data rates may apply, and message frequency may vary.

  2. User Opt-Out: To stop receiving messages, reply with STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us. You may receive a confirmation message verifying your decision. Our system only recognizes the specified keywords for opting out; any deviation may not trigger successful opt-out.

  3. Program Description: The Program includes messages about our offerings, promotions, sales, and other marketing-related content for Shop Austins products. Messages outside this scope may not be covered under applicable laws.

  4. Cost and Frequency: Message and data rates may apply, and the number of messages may vary based on user interaction with our Program.

  5. Support Instructions: For assistance, text HELP to the number you received messages from or email us at support@shopaustins.com. Opt-outs must follow the designated keywords for confirmation.

  6. MMS Disclosure: Messages may include SMS terminating messages for devices that do not support MMS.

  7. Disclaimer of Warranty: The Program is provided "as-is" and may not work in all areas or with all carriers. We are not liable for delays or delivery issues beyond our control.

  8. Participant Requirements: Participation in the Program requires a compatible wireless device with text-messaging capabilities.

  9. Age Restriction: You must be at least 13 years old to participate, with parental consent if you’re under 18.

  10. Prohibited Content: Prohibited content includes any form of unlawful, harassing, defamatory, or objectionable content, viruses, pirated software, or any prohibited by applicable law.

  11. Dispute Resolution: Disputes are subject to arbitration in [Insert City and State], governed by the laws of the Federal Judicial Circuit applicable to Shop Austins. Arbitrations shall be binding and final, with no class or representative claims allowed.

  12. State Law: We aim to comply with state-specific regulations where applicable, including telemarketing laws in states like Florida and Washington.

  13. Miscellaneous: Any new features, changes, or updates to the Program will be subject to these terms unless otherwise stated. You agree to periodically review this Agreement to remain informed about any changes.
